Terms of Service

1. Agreement

These Terms govern your use of Attendance (the “Service”). By accessing the Service, you agree to these Terms and our Privacy Policy.

2. Who may use

You must be an instructor or enrolled student a higher education institution. The Service may require sign-in with an approved university Google account.

3. Your responsibilities

We may suspend or terminate access for suspected misuse.

4. Instructor/administrator obligations

Instructors are responsible for configuring allowed email domains and course options, managing the underlying Google Sheet(s) and access, and complying with institutional policies (e.g., FERPA) regarding student records.

5. Privacy

Your use is also governed by our Privacy Policy, which explains what we collect and how we use it.

6. Third-party services

The Service relies on third parties (e.g., Google OAuth, Google Cloud, Cloudflare). We are not responsible for their outages or changes.

7. Intellectual property & license

We grant you a limited, non-exclusive, revocable license to use the Service for classroom attendance. All rights not expressly granted are reserved by Robert Stewart.

8. Disclaimers

The Service is provided “as is” and “as available.” We do not warrant uninterrupted or error-free operation.

9. Limitation of liability

To the fullest extent permitted by law, Robert Stewart will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data or profits, arising from or related to your use of the Service.

10. Indemnification

You agree to indemnify and hold harmless Robert Stewart from claims arising from your misuse of the Service or violation of these Terms.

11. Termination

We may suspend or terminate access at any time for violation of these Terms or to protect the Service. Upon termination, your right to use the Service ends.

12. Changes

We may update these Terms. Material changes will be posted with an updated Effective date.

13. Governing law

These Terms are governed by the laws of Maryland, USA (without regard to conflicts of law). Venue and jurisdiction lie in the courts of Prince George's County, Maryland, USA.
